Terms and Conditions

These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Dr Sam Aesthetics Ltd, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Dr Sam Aesthetics Ltd and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Dr Sam Aesthetics  Ltd and accessing the Website in connection with the provision of such services.

You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.


Who We Are

www.drsam.co.uk is operated by Dr Sam Aesthetics Ltd (“we”, “us” or “our”). We are registered in England under company number 13739264 and have our registered office at Lasyard House, Underhill Street, Bridgnorth, Shropshire, United Kingdom, WV16 4BB


Intellectual property and acceptable use
All Content included on the Website, unless uploaded by Users, is the property of Dr Sam Aesthetics  Ltd, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission
You may, for your own personal, non-commercial use only, do the following:
retrieve, display and view the Content on a computer screen
You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Dr Sam Aesthetics  Ltd.
Prohibited use:
You may not use the Website for any of the following purposes:
in any way which causes, or may cause, damage to the Website or interferes with any other person’s use or enjoyment of the Website;
in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law, regulation, governmental order;
making, transmitting or storing electronic copies of Content protected by copyright without the permission of the owner.


Registration:
You must ensure that the details provided by you on registration or at any time are correct and complete.
You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.
We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.
You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the Website. Cancellation or suspension of your registration does not affect any statutory rights.


Appointments And Cancellations

All appointments are made subject to availability and on payment of the relevant deposit.

Deposit
Consultations: £50
Treatments:  £50 or  50% of the treatment cost (dependant on the treatment required)

Appointments will not be secured without payment of a deposit. If there is a delay in making a deposit payment, your appointment time may be allocated to another client.

We ask that you arrive on time to any scheduled appointment and to complete the pre-medical forms that are emailed to you beforehand. If you arrive late, we will do our best to accommodate you, but it may result in you not being treated and any deposit being forfeited. 

The clinic is not suitable for young children so please do not bring children to your appointment.

Any treatment recommended at a consultation must be undertaken within 6 months, otherwise a new consultation will be necessary.  

Before your appointment you will be given details of any preparation you are required to do in advance of any treatment. If you fail to follow the pre-treatment procedure, we may not be able to proceed with your treatment and may result in your deposit being forfeited. 

You can change or cancel a consultation 48 hours before it is scheduled. Any changes or cancellations to a consultation appointment within 48 hours may result in your deposit being forfeited.

Cancellation of a scheduled treatment requires 10 days’ prior notice. Treatments may be transferred to another date with 48 hours’ prior notice provided that any re-scheduled date is within 2 months of the original appointment. 

There may be situations outside of our control which may result in us needing to cancel appointments at short notice. In such circumstances, we will endeavour to offer you the next available appointment. If a new appointment cannot be arranged, we will offer you a refund.  

Treatments

At your consultation we will assess the suitability of any treatment. It may be that it is determined that the treatments we offer are not suitable for you. In such instances, you may not be entitled to a refund of your consultation fee.

Where we offer a course of treatments, the cost of the entire course must be paid in advance of the first treatment. 

As a course of treatments offers you a discounted rate, they are non-refundable save where medical conditions preclude you from having the treatment. Evidence from your doctor is required in order to process your refund and any amounts refunded will be calculated based on any treatments not yet claimed. 

Promotions

We may from time to time run promotions for products and/or services. 

All promotions will have separate terms and conditions and will be subject to availability and eligibility.

Promotions may change without notice so please ensure you check our site for the most up to date promotions.

Treatments are not refundable under any circumstances.

Fees charged for treatment are for the delivery of a treatment and the accompanying service, which is inclusive of;

consultation and assessment
provision of information and advice
safe treatment with evidence based products
follow up appointments and aftercare advice and support as appropriate
Whilst we undertake to provide excellent service; factual, honest and ethical advice, safe, expert treatment in experienced hands and only the best products, we cannot guarantee your results and cannot offer refunds if the results achieved fail to meet your expectations.

Complaints

We hope that you are always satisfied with the service you receive from Dr. Sam Aesthetics. However, if there is any matter you are not satisfied with, please contact us by email to info@drsam.co.uk or WhatsApp.

Please note that complaints made via social media are not monitored.

Formal complaints are acknowledged in writing or in person within 48 hours.
The acknowledgment provides contact details for the person who is handling the complaint, how the complaint will be dealt with and how long it is expected to take.
If a complaint raises issues that require notification or consultation with an external body, the notification or consultation will occur within 3 days of those issues being identified.
Formal complaints are investigated and resolved within 28 days.
If the complaint is not resolved within that time period days, the complainant will be provided with an update.


Our Responsibility For Loss Or Damage Suffered By You
It is your responsibility to provide us with accurate and up to date details of your medical history, at any consultation and prior to any treatment. Dr. Sam Aesthetics will not be liable for any loss or damage suffered by you as a result of your failure to disclose relevant medical details.

We only supply products for domestic and private use. If you use products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We shall not be liable to you, whether in contract, tort, for breach of statutory duty, or otherwise, arising under or in connection with our provision of any services and products for any special, consequential or indirect loss or damage or for the following direct losses or direct damages:

Loss of profits;
Loss of anticipated earnings;
Loss of revenues;
Loss of business opportunities;
Loss of property; or
Loss of goodwill.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We will only use your personal information as set out in our privacy policy.

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

This website may include information and materials uploaded by other users of the site, including to bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

We do not guarantee that our site will be secure or free from bugs or viruses.
